Question by jaguar: California speeding and no proof of insurance ticket?
It was dark and raining. I just came off the bay bridge in SF and am positive I was driving below 40 on the bridge and between 40-60 when I got off the bridge. The cop was on 80E past fremont exit. He said I was at 67 in a 50 zone and also did not give me enough time to look for my proof of insurance. He said “lets make this easy and quick” and cited me for speeding and for “no insurance” and not no proof of insurance. He cited both as non-correctable. It this accurate? I don’t think his radar reading isaccurate. How can Ichallenge this?

    Obviously you will have to appear in court. The “no Insurance” will be reported to the DMV, and they will automatically suspend your car registration if you don’t clear that up immediately.

    Appear in court on the day you promised to appear, an request a trial. Take your Proof of Insurance and ask that that charge be dismissed. If you didn’t actually have insurance on the day of the citation the court will order you to buy insurance, and you can expect the registration suspension action from the DMV.

    As for the Speeding, you’re on your own. The court usually puts more value on the police officer’s testimony than the defendants. If the cop shows up (and they almost ALWAYS do ) you’re screwed on that charge. If you can get the Insurance charge dropped then just ask for “Traffic School” on the Speeding charge.

    I agree with the other answerer if you had insurance go to court show you has proof of insurance. That judge listens to the same stuff day in and day out the best thing to do is apologize for not having the document you needed when the cop stopped you and you apologize for wasting the coutts time PAY THE FINE or ask to go to traffic school te keep the ticket off your record so it will not affect your insurance. the no insurance gets dismissed . You will be out of there as soon as its your chance to be in ftront of a judge

    Go to court and show that you have insurance. Apologize that you weren’t able to find it fast enough.
