Question by Veronica C: Help!! What can I do to help my mother who was hit by an owner of a car with no insurance??
My mother was hit by this car as a pedestrian. Of course she took down his license plate number as well as other necessary information. Even the phone number of his “insurance.” Turned out that he wasn’t the owner of the car and that his dad/or bro who owned it had no insurance at the time of the accident. No lawyer will hear her case since they say they can’t get money from a guy with no insurance and my mom is stuck with hospital bills, ambulance bills, and therapy bills. Please if anyone has expert advice or could point me in the right direction, I’d greatly appreciate it. This is unfair and I’m desperate. We even tried to contact the guy but he said his lawyer and ours (who soon after rejected our case) should discuss everything. We’ve constantly hit dead ends. Please help!!!!!
My mom only has liability and through a small claims court she won’t get enough money to cover the ridiculous bills she’s been charged. Unfortunately, she cannot get medical insurance. We live in CA and I’m not sure why, but now that she is 60 or so she cannot get it. She has nothing to help her pay the bills right now and all I can wonder is how in the heck can this man sleep at night. My mom was in her right of way crossing within white lines and this guy hits her, doesn’t apologize, barely talks to her to giver her his info and then doesn’t want to be held accountable.

The way u’re telling the story, it seem to me like this was a hit and run situation. Insurance or no insirance…according to the law, he should be responsible for his action.
I’m hoping there was a police report or some sort of report that was filed after the accident. If you have enough information to sue this guy then go ahead. He should be arrested and charged regardless if he had insurance or not. I’m not sure which lawyer you spoke to…but he sure isn’t telling you the right thing.
This is a crime under the law….it’s just like handing some1 a traffic voilation ticket…..Insurance companies don’t pay tickets and they don’t have to pay for accidents they’re not responsible for either. That guy needs to pay.
You need to find the right person to represent you….and I hope this guy get some time too.
Your lawyer is right-you can’t get blood from a stone. Unfair? Yup. Report it to the police so they can take his license for driving without insurance.

Well….
If your mother has her own auto insurance policy…she may be covered under her own auto policy. There is a provision in most auto policies that provides coverage for injuries sustained while in, on and sometimes even NEAR a vehicle. (unfortunately I do not have a personal auto policy here to review and quote specific language.)
I have handled injury claims for passengers who were injured while getting into a vehicle and even for people whose feet were run over by vehicles.
You should have her check with her agent asap.

Also – does she not have medical insurance? SSDI? or medicare or something?
If your state has an uninsured motorist fund, which some states maintain by allowing motorists to self-insure by paying into the fund, your mother may be able to file a claim to be paid out of that fund. It’s worth checking out.
SMALL CLAIMS COURT AND SUE BY YOURSELF OR HIRE AN ATTORNEY BUT BOTH WAYS YOU WILL BE TRYING TO BLOOD OUT OF A ROCK AND IT JUST DOESN’T WORK.
DO SOME RESEARCH ON YOUR OWN AND FIND OUT IF THE OTHER PERSON OWNS ANYTHING, LIKE A CAR, BOAT OR ANYTHING AND FILE WITH THE SMALL CLAIMS COURT AND GET A JUDGMENT ON THEIR ASSISTS AND HOPE FOR THE BEST.
In the UK there is an agency called the Motor Bureau who are set up for exactly that reason – if a person is injured/killed by an uninsured third party and needs to recover losses There is also the Claims assistance bureau who are more governed by insurance companies. Also on insurance policies there can be third party liability cover as well.
Seek charity care. They can’t hold her liable for someone else’s irresponsibility. As long as she was in the right of way to cross she should be able to at least get charity care. And take it to small claims court!!
